This CAP Agreement is made and entered into between Nexsis Biosciences and Customer as of the Effective Date and shall remain in effect until the date above.
This CAP Agreement is exclusive between Customer and Nexsis Biosciences. Either party may terminate this CAP Agreement with thirty (30) days written notice to the other party. Please allow up to three (3) business days from the parties’ last signature date for processing and establishment of the Effective Date. Upon such, Nexsis BioSciences will provide Customer with confirmation of this CAP Agreement’s Effective Date. The parties agree the pricing herein will not be effective until this CAP Agreement’s Effective Date and, thereby, waive any and all claims as to price discrepancies associated to this CAP Agreement prior to such date.
This pricing quotation is created for the Customer listed above and is determined based on potential purchases of Nexsis BioSciences products provided by such Customer. The parties agree this pricing quotation shall remain confidential and may not be shared with any third party without the other party’s written consent. The products and pricing contained herein are solely for the parties’ analytical use and, thus, expressly non-binding. Only upon the parties’ proper execution of the associated Pricing Agreement shall any pricing be enforceable. This pricing quotation is valid only for thirty (30) days from the above date.
*Nexsis Durasis is the exact same product as the previously supplied Cook Biotech's Biodesign® Dural Graft
+Cook Biotech's Biodesign® Dural Graft part numbers will be completely replaced by Nexsis Durasis part numbers effective August 1, 2025.
