This CAP Agreement is made and entered into between Nexsis Biosciences and Customer as of the Effective Date below and shall remain in effect until the Approved Until Date below. Nexsis Biosciences agrees to provide Customer the pricing stated below and both parties agree (as indicated by the parties’ signatures below).
This CAP Agreement is exclusive between Customer’s membership and Nexsis Biosciences and is not transferable by either party. Either party may terminate this CAP Agreement with thirty (30) days written notice to the other party. Please allow up to three (3) business days from the parties’ last signature date for processing and establishment of the Effective Date. Upon such, Nexsis Biosciences will provide Customer confirmation of this CAP Agreement’s Effective Date. The parties agree the pricing herein will not be effective until this CAP Agreement’s Effective Date and, thereby, waive any and all claims as to price discrepancies associated to this CAP Agreement prior to such date.
